Terms & Conditions
1. Scope
These General Terms and Conditions (T&C) apply to the purchase of tickets, table reservations and the attendance of events at Pearl Club, operated by JMD Event-Ticketing GmbH, Maysedergasse 2/3, 1010 Vienna (hereinafter “Pearl Club”). Deviating terms of the guest do not apply.
2. Contract and tickets
Tickets are sold via our online ticket shop (tickets.pearlclub.at). The contract is concluded upon completion of the order process and payment confirmation. Tickets are delivered as e-tickets with QR code by email and must be presented at entry. Commercial resale of tickets is prohibited.
3. Prices and payment
Unless expressly stated otherwise, all prices are in euros and include applicable statutory taxes and charges. Payment is made via the payment methods offered in the ticket shop.
4. No right of withdrawal
As our events are leisure services with a fixed date, there is no statutory right of withdrawal pursuant to § 18 para 1 no 10 of the Austrian FAGG. Every ticket purchase is binding.
5. Cancellation, event cancellation and postponement
Tickets cannot be exchanged or returned. If an event is cancelled or postponed, we will inform you by email about your options (rebooking or refund of the ticket price). Table reservations can be cancelled free of charge up to 4 days before the date; after that, a cancellation fee of EUR 50.00 per person may be charged.
6. Age policy
Unless stated otherwise, our events are open to guests aged 18 and over. A valid official photo ID may be required at entry. Without appropriate proof, entry may be refused without any right to a refund.
7. Entry and house rules
The house rules of Pearl Club apply. Entry may be refused to persons who are intoxicated or under the influence of drugs, endanger or harass other guests, or violate the house rules or dress code. In such cases there is no right to a refund of the ticket price.
8. Programme changes
Changes to the programme, performers or schedule remain reserved, provided they do not materially change the overall character of the event and are reasonable for the guest.
9. Force majeure and technical disruptions
Pearl Club assumes no liability beyond statutory provisions for cancellations or restrictions due to force majeure, official orders or technical disruptions outside the control of Pearl Club.
10. Liability
Pearl Club is only liable for damage caused by intent or gross negligence; this does not apply to personal injury. Liability for items brought along and cloakroom items exists only within the statutory framework. Guests are liable for damage they cause.
11. Photo and video recordings
Photo and video recordings may be made at events for documentation and promotional purposes. By attending the event, guests consent to recordings in which they are recognisable as part of the audience being made and published.
12. Final provisions
Austrian law applies, excluding its conflict-of-law rules. The place of jurisdiction is Vienna, where legally permissible. The contract language is German; in case of discrepancies between the German and English versions, the German version prevails. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
